Global Leaders in Media Law Practice
A completely revised Data Protection Act (DPA) will strengthen the rights of individuals, increase transparency of data processing and increase the obligation of data controllers.
The Swiss Federal Council initiated a consultation on the revised DPA in December last year, which ended in April this year.
The revision of the DPA, which is expected to come into force in 2018, is intended to align local laws with the requirements of the EU General Data Protection Regulation.
Among changes, the new law retracts protection for legal entities and increases the rights of data subjects to make decisions about their own data. The draft legislation also emphasises the importance of self-regulation.
With a data-driven economy, Switzerland is positioning itself as a haven for the storage of confidential physical and digital data for local and international companies.
In April last year the Federal Council adopted the Digital Switzerland strategy that has data security as its core focus.
The country’s Digital Manifesto for Switzerland is a further initiative intended to aid digital
transformation. Put together by 50 entrepreneurs, academics and politicians, the manifesto will work as a comprehensive blueprint for the digitalisation of the country.
Speaking of the significance of data in a digital environment, Thomas Legler, a partner at Pestalozzi Law, said: “I believe that with any kind of video information and digital data, you have a data protection issue. We have seen a huge increase in the area of data protection questions.”
He added: “There is a concentration of the media market with companies looking around for international partners.”
