Driven by digitalisation, the media market is on an upward trend of expansion. Direct-to-home television dominates the broadcast industry while print media competition is high with new titles competing with established dailies.
Government support for media market expansion was made clear after Prime Minister Narendra Modi raised the ownership limit to 49 per cent across the broadcasting sector, an increase from 26 per cent.
Effective in September, the change to the country’s foreign direct investment (FDI) policy highlighted allowable foreign investment in television news channels and private FM radio.
Economic Affairs Secretary Shaktikanta Das said: “The government’s decision on liberalising FDI policy is a welcome step and is part of improving the ease of doing business.”
As noted by Rahul Chaudhry at Lall Lahiri & Salhotra, “Media is becoming increasingly powerful.” In the process copyright protection is becoming more important. Lawyers say emerging
trends highlight the need for copyright law reform as infringement continues in a rapidly expanding market.
While closely following international standards, Indian copyright law fails to take into account works of parody. Mr Chaudhry explained: “The lack of regulation in this particular area has resulted in numerous lawsuits against parodists by owners of original works claiming infringement of copyright.”
According to industry research conducted by consulting firm KPMG, media and entertainment market growth will continue this year and is expected to reach USD 18.5 billion.
Gaming will be worth USD 441 million by the end of the year while television advertising has seen ‘strong growth, driven by the positive shift in the macroeconomic environment.’
